Consent to Telehealth

Purpose

This consent ("Consent") gives you information about telehealth and obtains your informed consent to receive healthcare services through telehealth from the physicians, physician assistants, and nurse practitioners (the "Providers") who deliver care through the platform operated by Tomorrow Health Inc. (the "Service"). The Providers practice as part of Arora Health & Aesthetics, LLC and any other licensed medical group made available through the Service (the "Medical Group"). "You" and "your" refer to the person using the Service.

What telehealth is

Telehealth is the delivery of healthcare services using electronic communications and information technology between a provider and a patient who are not in the same physical location. It may be used for evaluation, diagnosis, treatment, follow-up, and patient education, and can include the electronic transmission of medical records, images, personal health information, and other data between you and a Provider; communication by audio, video, messaging, or email; and the use of data from connected devices. Alternative care, such as in-person services, may be available to you, and you may choose an alternative at any time. Always discuss alternatives with your Provider.

Potential benefits

Telehealth may make it easier and more efficient to access care; allow you to receive care at times convenient to you; and let you interact with a Provider without an in-office visit.

Potential risks

Telehealth also carries potential risks, including but not limited to: the quality, accuracy, or effectiveness of care may be limited; technology, including the Service, may contain errors or fail, which could make it unavailable, produce incorrect records or data, or cause data to be lost or corrupted, any of which could affect your care; the inability to perform an in-person examination or assess vital signs may prevent a Provider from making a diagnosis, providing treatment, or identifying a need for emergency care; a Provider may be unable to treat your condition, requiring you to seek alternative or emergency care; delays in evaluation or treatment may occur due to Provider availability or technical failures; security measures could fail, resulting in a breach of your information; information shared electronically, including by email, may be more vulnerable to unintended disclosure; regulatory requirements in some states may limit a Provider's diagnosis or treatment options, particularly for certain prescriptions; and a lack of access to your full medical records could contribute to adverse drug interactions, allergic reactions, or other errors in judgment.

Emergencies and follow-up care

If you are experiencing a life-threatening situation, including thoughts of suicide, call 911 or the 988 Suicide & Crisis Lifeline at 988. If your situation is an emergency, call 911. Telehealth is not appropriate for every situation. If you need immediate or urgent care, seek it at an emergency room or another facility equipped to provide it. Providers may not respond promptly to messages submitted through the Service. If you are not experiencing an emergency and do not need immediate care, you may communicate with Providers through the Service's secure messaging.

Privacy and data protection

The Service uses network and software security measures intended to protect the privacy and security of your information and to guard against corruption of data. Information that identifies you or contains protected health information will not be disclosed to a third party without your consent, except as permitted or required by law — for example, for consultation, treatment, payment and billing, and certain administrative purposes, and for legally mandated disclosures such as reporting a danger to self or others or suspected abuse of a child, elder, or vulnerable adult — or as described in your Provider's Notice of Privacy Practices. Use of the Service may include email communications that contain your protected health information. Tomorrow does not and cannot guarantee the security or privacy of third-party services you use to receive these communications, such as your email provider.

Your acknowledgments

By accepting this Consent, you agree and acknowledge that:

  • Healthcare services provided through the Service are delivered by telehealth. In some cases your treating Provider may be a nurse practitioner or physician assistant rather than a physician, and you agree to be treated by non-physician Providers where applicable.
  • The technology used to deliver care, including the Service, may contain errors that could limit functionality, produce incorrect results or records, or cause data to be lost or corrupted, any of which could affect the quality, accuracy, or effectiveness of your care.
  • Telehealth is an evolving field, and your care may involve technologies not specifically described in this Consent.
  • No specific benefit or result can be guaranteed. Your condition may not improve and, in some cases, may worsen.
  • There are limitations to care delivered by telehealth, and you may not be able to receive diagnosis or treatment through the Service for every condition.
  • There are potential risks to telehealth, including those described above, and you have the opportunity to discuss the benefits, risks, and alternatives with your Provider.
  • There will be no recording of any telehealth session by you or your Provider.
  • Your Provider will assess your condition and, in their sole professional judgment, determine whether it is appropriate to diagnose or treat you via telehealth. By continuing to use the Service, you agree with that assessment and agree to receive diagnosis and/or treatment via telehealth.
  • Your Provider may determine, in their sole judgment, that your condition is not suitable for telehealth and that you should seek care from a specialist or other in-person provider.
  • You may withdraw your consent to telehealth at any time, without affecting your right to future care and without losing any benefits to which you are entitled — but you understand the Providers using the Service do not offer in-person treatment. Withdrawal is effective when your Provider receives written notice and does not affect any action taken in reliance on this Consent beforehand. Withdrawing does not affect the remaining provisions of this Consent.
  • Use of the Service involves the electronic exchange of your personal medical information, including by email.
  • It is your responsibility to give Tomorrow and your Providers truthful, accurate, and complete information, including relevant information about care you have received or are receiving from other providers, and emergency contact information for your local healthcare providers.
  • Your prescriptions will be fulfilled and shipped to you through the Service's licensed pharmacy partners, including VialsRX. You may use a pharmacy of your choice by contacting support and notifying your prescribing Provider through secure messaging. Prescriptions may be filled by, and transferred among, the pharmacy partners on your behalf.
  • You are responsible for the full cost of the Service, including any prescription, on a self-pay basis, and you will not submit claims to Medicare, any other federal payor, or any state or private insurer.
